JSC «Belshina» thanks you for your joint work and draws your attention to the introduction of the mechanism of marking goods with means of identification in the territory of the Republic of Belarus from July 8, 2021, according to which:
economic entities, engaged in the circulation of goods with means of identification not containing anti-counterfeiting elements, are obliged to use commodity-transport and (or) consignment notes, created in the form of electronic documents (hereinafter - electronic consignment notes), which contain information about the applied means of identification (Decree of the President of the Republic of Belarus from 10.06.2011 № 243 «On labeling of goods» with amendments from 06.01.2021).
From 01.12.2021 the requirement of mandatory labeling will apply to tires, in connection with which business entities engaged in the circulation of tires, from the above-mentioned date will be obliged to use electronic consignment notes.
In view of the above, please provide for the conclusion of appropriate agreements with EDI providers, as well as technical and organizational readiness of your organization to use electronic consignment notes.
Contributions to occupational pension insurance (hereinafter - PPI contributions) are paid for employees employed at workplaces included in the list of workplaces with special working conditions.
The categories of employees subject to PPP are defined by the relevant lists and lists (Article 5 of the Law of the Republic of Belarus of 05.01.2008 No. 322-З «On Occupational Pension Insurance» (hereinafter - Law No. 322-З)).
The object for accrual of contributions to PPS is payments of all kinds in cash and (or) in kind, accrued to an employee in connection with his employment at a workplace included in the list of workplaces with special working conditions, except for payments provided for by List No. 115, on which mandatory insurance contributions to the budget of the state extra-budgetary fund of social protection of the population of the Republic of Belarus are not accrued.
At the same time, the amount of payments exceeding three times the amount of the average wage of employees in the country for the month preceding the month for which occupational pension insurance contributions are paid is not subject to these contributions (paragraph 2 of Article 7 of Law No. 322-З).
The payment of contributions to PPS for employees who have reached the general retirement age, as well as for employees who have chosen a monthly salary supplement instead of PPS, is not made (paragraph 5, Article 7, Law No. 322-З).
Employees who are subject to occupational pension insurance and whose special length of service before January 1, 2009 is less than half of that required for the granting of an old-age pension for work with special working conditions or a long-service pension in accordance with Articles 12, 13, 15, 47-49, 49-2 of the Law of the Republic of Belarus «On Pension Provision» are entitled, at their choice, to occupational pension insurance or to a monthly supplement to wages in the amount determined by the employer, but not less than the amount of contributions to occupational pension insurance.
In this case, the monthly supplement to the salary is made by the employer on the basis of a written application of the employee (subpar. 1.2 of the Decree of the President of the Republic of Belarus No. 441 of 25.09.2013 «On Some Issues of Professional Pension Insurance and Pension Provision».
For reference: The tariffs at which employers pay contributions for professional pension insurance are established by Article 6 of the Law of the Republic of Belarus of 15.07.2021 № 118-З «On contributions to the budget of the state off-budget fund of social protection of the population of the Republic of Belarus».
The amount of tariffs, accordingly, depends on the category of employees subject to occupational pension insurance.
The amount of PPP contributions is calculated as the product of the object for assessing PPP contributions and the tariff.
Example: An employee who is engaged in special working conditions wrote an application for a monthly supplement in January 2022.
The employee's salary for February 2022 amounted to 500 roubles. The PPP contribution rate is 4%.
The amount of PPP contributions for February 2022 will be 20 rubles (500 rubles x 4%).
Thus, the surcharge can be set at a minimum of 20 rubles.
